GIVEAWAY – TERMS AND CONDITIONS
1. GENERAL
1.1. Cigno Australia Pty Ltd (ABN: 41648971626) of 34 Nerang Street Southport QLD 4215, (hereinafter referred to as ‘We’ or ‘Us’ or ‘Our’), conducts daily and weekly trade promotions by way of lucky draws (hereinafter referred to as the ‘Daily Competition’ and ‘Weekly Competition’ respectively) for its members (hereinafter referred to as ‘You’ or ‘Your’).
1.2. The following are the terms and conditions of entry into the Daily Competitions and Weekly Competitions. Your entry into the Daily Competitions and Weekly Competitions constitutes acceptance of these terms and conditions.
1.3. If there are any inconsistencies between these terms and conditions and any other document that refers to either a Daily Competition or a Weekly competition, these terms and conditions will prevail.
2. ELIGIBILITY
2.1. Entry is open to all Australian residents except our employees, immediate families and their associated companies and agencies via Our web and app platforms provided that:
(a) You agree to comply with these terms and conditions; and
(b) You have purchased a membership pack from Us in accordance with clause 3 below.
For the purposes of this clause, immediate family includes the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, step-sister or first cousin.
2.2. Entry is subject to all state laws and regulations and is void where prohibited.
3. ENTRYS FOR THE CONTEST
3.1. You may purchase a membership pack from us via our web and app platforms which will automatically enter you into the Daily Competition and the Weekly Competition. Depending on the membership pack that you purchase the number of entries that you receive into each competition varies as follows:
(a) Basic
(i) Five (5) entries into every Daily Competition for the duration of the membership; and
(ii) Ten (10) entries into every Weekly Competition for the duration of the membership.
(b) Standard
(i) Fifteen (15) entries into every Daily Competition for the duration of the membership; and
(ii) Thirty (30) entries into every Weekly Competition for the duration of the membership.
(c) Value
(i) Fifty (50) entries into every Daily Competition for the duration of the membership; and
(ii) One hundred (100) entries into every Weekly Competition for the duration of the membership.
4. THE PRIZES
4.1. The prizes for the competitions are as follows:
(i) The Daily Competition: $250.00 cash.
(ii) The Weekly Competition: $1,000.00 cash.
5. COMPETITION DRAWS AND WINNER ANNOUNCEMENTS
5.1 The Daily Competitions commence at 12.00am AEST and conclude at 11.59PM AEST every day until further notice. Prize will be drawn the following day at 12pm AEST.
5.2. The Weekly Competitions commence at 12.00am AEST every Friday and concludes at 11.59pm AEST every Thursday until further notice. Prizes will be drawn at 12.00pm every Friday.
5.3. The Winners of each Daily Competition and each Weekly Competition will be announced on Our web and app platforms and social media platforms the day immediately following each draw. We will also try to contact the Winners by phone or email.
5.4. Winners must contact Us to claim the prize upon which the prize will be deposited into the bank account of the Winner within seven (7) days.
5.5. If a Daily Competition prize is unclaimed after seven (7) days, the prize will then be redrawn, and a new winner announced per clause 5.3 above.
5.6. If a Weekly Competition prize is unclaimed after one month, the prize will then be redrawn, and a new winner announced per clause 5.3 above.
6. WINNERS TICKET
6.1. All trade promotions are administered on Our behalf by Fi-Fit Services Pty Ltd (ABN: 76 626 283 645) trading as Winners Ticket.
6.2. By entering into either the Weekly Competition or the Daily Competition you agree to the Winners Ticket Terms of Use and the Winners Ticket Privacy Policy.
6.3. You consent to us providing your personal information to Winners Ticket in accordance with our Privacy Policy for the purposes of administering the trade promotions that you have entered.
6.4. You consent and agree to Winners Ticket retaining your information and contacting you in any manner (including SMS, email, and phone call) for the purposes of marketing and promotion of various goods and services.
7. REPRESENTATIONS AND WARRANTIES
7.1. We warrant the following:
(a) The purpose of the trade promotions is to bring awareness to Our brand.
(b) We do not sell raffle tickets or other type tickets related to the trade promotions.
(c) The prizes are strictly a promotional giveaway and can be won by any person that purchases a membership pack thereby becoming a customer of Ours.
(d) Entries to the Daily Competitions and the Weekly Competitions are only provided as promotion for Our membership packs and cannot be purchased and will not be sold separately.
7.2. You warrant the following:
(a) That you will not contact any of Our affiliates, employees, sponsors or partners in order to manipulate the results of the trade promotions.
8. DISCLAIMERS
8.1. By purchasing a membership pack, you agree:
(a) To enter the Daily Competitions and Weekly Competitions;
(b) Any and all disputes, claims and causes of action arising out of or in connection one of our trade promotions or the prizes shall be resolved individually without any form of class action;
(c) Any claims judgments and awards shall be limited to actual out of pocket costs incurred in entering the trade promotions, but under no circumstances will We be responsible costs related to any legal actions;
(d) You hereby waive all rights to claim punitive, incidental or consequential damage and any rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out of pocket expenses incurred in entering the Daily Competitions and Weekly competitions;
(e) In no event will We, Our licensees, parents, affiliates, subsidiaries and related companies, Our advertising or promotional agencies or their respective officers, directors, employees, representatives and agents, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising from access to, or use of, our web and app platforms or Your entrance into the trade promotions – even if We were advised of the possibility of such damages;
(f) We reserve the right to disqualify any participant in the trade promotions who is found to be tampering with or otherwise abusing any aspect of the trade promotion at Our sole discretion;
(g) In the event a trade promotion is compromised by unauthorised human intervention, tampering or other causes beyond Our reasonable control thereby corrupting or impairing the administration, security, fairness or proper operation of the trade promotion, We reserve the right to suspend, modify or terminate the trade promotion;
(h) In the case of the intervention of any outside act, agent or event which prevents or significantly hinders Our ability to proceed with the trade promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, We may in its absolute discretion cancel the trade promotion and recommence it from the start on the same conditions, subject to any directions given under state regulation.
(i) Any attempt by a participant in a trade promotion to deliberately undermine the legitimate operation of a trade promotion is a violation of criminal and civil laws and We reserve the right to seek damages to the fullest extent permitted by Law; and
(j) We assume no responsibility for any technical malfunction of our computer systems, servers, software, internet service provider, or e-mail systems, failure of any entry to be received on account of technical problems or incomplete, late, lost, damaged, illegible, or misdirected electronic communications, or any combination thereof.

10. COPYRIGHT, STATUTORY GUARANTEES, WAIVER AND LIABILITY
10.1. In consideration for Us awarding a prize to a winner of a Daily Competition or Weekly Competition, the winner hereby permits the winner’s submission, image and/or voice, as recorded, photographed, or filmed during the winner’s participation in/with the prize to appear in advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
10.2. We are not responsible for any incorrect or inaccurate information or for any technical error that may occur during the administration of the trade promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
10.3. We reserve the right, at our sole discretion to disqualify any individual who we have reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of a trade promotion. We reserve all Our legal rights to recover damages or other compensation from such an offender.
10.4. We collect information about you in accordance with our privacy policy including for example your name and email address which you provide when entering the competition. We collect and use that information to provide you with our goods and services and to promote and improve our goods and services. We may use your information as described when we collect information from you.

10.6. By entering one of our competitions, you hereby consent to us retaining your information and contacting you in the future for the purposes of promotion and marketing. You may opt out of at any time by contacting and advising us of the same.
